The Employee Retention Credit

ERC Eligible Requirements

  • If your business operations were impacted during an applicable calendar quarter due to government order that required partial or full shutdown of your business during 2020 or 2021.  This includes business operations being limited by commerce, inability to travel or restrictions of group meeting.

    OR

  • If your business gross receipts decreased more than 20%, comparing quarters in 2021 to the same quarter in 2019 or the immediately preceding quarter.

How much is the ERC tax credit?

For 2020, the maximum credit for all quarters is $5,000 per employee.  For 2021, the maximum credit for each quarter is $7,000 per employee for three quarters.  The maximum ERC tax credit for 2020 and 2021 is $26,000 per employee.

Do I qualify if I received PPP loans?

You can still qualify for the ERC refund checks, even if you received 1st and 2nd PPP Loans. However, you cannot use the same wages that you used to qualify for PPP loans.  So the key to maximum your ERC refund checks is to carefully allocate wages to each program to maximize ERC credits.

How long do I have to wait for ERC refund checks?

The current wait time for the IRS to process and issue ERC refund checks is between 8 and 10 months.  The IRS takes about 3-4 months to process a paper-filed amended and could be more if there are any potential errors on your employment form (Form 941X).  You may want to hire ERC professional to help you review your Form 941X and reach out to the IRS if they haven’t processed your ERC claim.
